Lumber King Flooring takes its responsibilities to protecting your data very seriously and we do advise you to get to know our practices. If there's anything in this policy you do not understand or if you want to ask any questions, please feel free to contact us.

This privacy policy aims to give you information on how we collect and process your personal data when you purchase products from us directly or through your use of the website, including any data you may provide through the websites when you sign up to our newsletter, purchase a product or take part in a competition.

We are committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

1.3   A note on the data we collect

Our website is not intended for children and we do not knowingly collect data relating to children. If you are a minor (below 18 years of age) shopping on our site, you cannot place an order.

Lumber King Flooring is a trading name of NE Online Flooring Ltd, a limited company registered in England and Wales under the company number 12751357 and our registered office address is Verdemar House, 230 Park View, Whitley Bay, Tyne & Wear, NE26 3QR. Our VAT registration number is GB 446 2349 88.

NE Online Flooring Ltd is the controller and responsible for your personal data (collectively referred to as "Lumber King Flooring", "Lumber King", "we", "us" or "our" in this privacy notice).

This privacy notice is designed to help you understand everything you need to know about the what, why and how of our data gathering and processing operations, and what your legal rights are as an individual.


3.2   Why do we collect personal data?

We collect personal information from our customers for the following purposes:

  • To provide you with goods and services you are looking for including manage payments, fees and charges and collect any money owed to us;

  • To arrange delivery of your goods, including free samples;

  • To improve the quality of the services we offer, and to better understand our customers' needs;

  • We shall not process any personal data that is not directly relevant to the above stated purpose.


3.3   What kind of personal data do we process?

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data includes first name, last name;

  • Contact Data includes address, email address, telephone and fax numbers;

  • Contact details of someone you appoint to receive a delivery on your behalf;

  • Details regarding you (or someone physically able to carry goods) being at your property on the day of delivery;

3.4   What kind of personal data do we not process?

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.


3.5   How do we collect your data?

We use different methods to collect data from and about you including through:


Direct interactions

You may give us your Identity, Contact and Financial Data by filling in application forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • apply for our products;

  • apply for a trade account;

  • create an account on our websites;

  • request a service from us;

  • request marketing to be sent to you;

  • enter a competition, promotion or survey; or

  • give us some feedback.


Third parties or publicly available sources

We may receive personal data about you from various third parties as set out below:

  • Technical Data from analytics providers such as Google based outside the EU;

  • Identity and Contact Data from publicly available sources such as Companies House and the Electoral Register based inside the EU, or social media platforms;

  • Credit Reference Agencies.


Automated technologies or interactions

As you interact with our websites, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies. Please see our Cookie Policy for further details.


3.6   Inform us of changes

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.


3.7   If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel the contract you have with us but we will notify you if this is the case at the time.


3.8   How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

Generally, we do not rely on consent as a legal basis for processing your personal data other than in relation to sending marketing communications to you via email, WhatsApp or text message. You have the right to withdraw consent to marketing at any time by contacting us.

4.1   How we use your personal data for marketing purposes

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising:


Promotional offers from us

We may use your Identity and Contact Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have requested information from us and/or previously purchased products from us and, in each case, you have not opted out of receiving that marketing. We may send you marketing communications relating to other brands.


Third-party marketing

We will get your express opt-in consent before we share your personal data with any company outside Lumber King Flooring for marketing purposes.


Opting out

You can ask us or third parties to stop sending you marketing messages at any time by contacting us at any time.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

Change of purpose

5.   The conditions of use

5.1   Contractual necessity

We may be required to process your personal information in order to deliver on the terms of a contract between us and yourself, or it may be to deliver on the terms of a contract that is not yet in place but where there is an intention that it soon shall be.

5.3   Who will we share your information with?

In order to achieve the above stated purposes for which we will process your personal data, we may need to share this information with various third-party organisations such as:

  • Service providers and agents who process data on our behalf e.g. internet service and platform providers, payment processing providers and those organisations we engage to help us send communications to you;

  • Credit reference agencies;

  • Couriers and delivery companies;

  • Product suppliers or manufacturers;

  • Sub-contractors necessary to deliver goods or services;

  • Professional advisers including lawyers, bankers, auditors and insurers based who provide consultancy, banking, legal, insurance and accounting services;

If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.


We will never share your personal data with Third-Parties that intend to use it for their own purposes. No third party will be allowed to use any of that data for any purpose unrelated to the purposes stated above.


5.4   Klarna

In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you.

Your personal data transferred is processed in line with Klarna’s own privacy notice.


5.5   Where is my data going to be kept?

We will not transfer your personal data to any country outside the list of countries approved by the EU Commission as having appropriate safeguards for data transfers.

Lumber King Flooring does however use the products and services of third party organisations that transfer or store personal data outside the list of countries approved by the EU Commission as having appropriate safeguards for data transfers. The following safeguards are in place to ensure that any third party data controller or data processor engaged by us has appropriate security measures in place:

  • We ensure that only the minimum data required for processing is shared with third parties.

  • We have a written agreement with third parties that requires them to treat personal data with the same levels of security and care that we are required to meet.


We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.


5.6   How long will we keep your data for?

We will keep your personal data only for as long as the purposes it has been gathered for, in line with this privacy policy, have expired, or until you request we delete the data and we have no relevant legal basis to use it.


5.7   Your rights, our responsibility

There are several rights granted to you immediately upon providing us with your personal information; we'd like you to know that we take your rights as seriously and will always conduct ourselves in a way that is considerate of our responsibility to serve your legal rights.


The Right of Access

This grants you the right to confirm whether or not your personal data is being processed, and to be provided with all the relevant details of what those processing operations are.

The Right of Erasure ('Right to be Forgotten')

You have the right to request that we erase all personal data we have about you, and we must respond to that request without undue delay. There are some conditions that apply with this right, but we will make every attempt to respond to a 'Right to be Forgotten' request within 30 days of receiving it.


The Right to Rectification

This one is fairly straightforward; if you notice that the data we have about you is inaccurate or incomplete, you may request we rectify the mistake. We will make every effort to respond to requests of this type immediately.


The Right to Restriction

You have the right to have us restrict the processing of your personal data and ensure that processing only takes place with your consent or for legal purposes.


The Right to Objection

The right to object is a basic freedom all democracies enjoy. If you wish to object to the way we use, or have used, your personal data you may do so freely.


The Right to Portability

This is a legal right afforded to you that most companies already provide; it basically states that if you request it, we must pass on all of the details you have given to us to another provider of your choosing.


The Right to Complain

We will always try to maintain the highest standards and encourage the confidence our customers have in us as an organisation.

In order that we can achieve this we do request that any complaints be first brought to our attention so we can properly investigate matters.
